我国现行法律禁止农村宅基地使用权自由流转,然而现实生活中农村宅基地使用权的隐性流转大量存在,并引发诸多社会矛盾。随着城市化、工业化、市场化的深入发展以及有的农村宅基地使用权流转试点证明了其存在的合理性,对农村宅基地使用权流转开禁已具备合理性及必要性。在渐进式地推进农村宅基地使用权的流转过程中,要以相关配套措施的完善为前提,设计完善的农村社会保障体系,设计建立农村宅基地有偿、有期限制度,完善宅基地使用权登记制度,明确宅基地使用权流转程序以及宅基地的回收制度,以构建合理高效的宅基地使用权流转机制,从而更好保障农民权益,促进土地利用效率的提高与城乡一体化的推进。
The current law in our country forbids the free circulation of the right to use house sites in rural areas. However, the hidden circulation of the right to use rural house sites exists in real life and leads to many social conflicts. With the further development of urbanization, industrialization and marketization, as well as the pilot transfer of the right to use homesteads in some rural areas, the rationality of their existence is proved. It is reasonable and necessary to prohibit the transfer of the right to use rural homestead. During the process of gradual advancement of the transfer of the right to use rural house sites, a well-designed rural social security system should be designed on the premise of the improvement of relevant supporting measures, and a system of compensating and expiration of rural house sites should be designed to improve the registration of the right to use house sites System, specifying the procedures for the transfer of the right to use homesteads and the recovery system of homesteads, in order to build a reasonable and efficient flow mechanism for the right to use homesteads so as to better protect the rights and interests of farmers and promote the improvement of land use efficiency and the integration of urban and rural areas.
