年终奖,顾名思义是用人单位在年终发给员工的一次性奖励。员工在辛勤一年之后,岁末将至之时获得一份丰厚的报酬自然倍感欣慰,因此,发放年终奖不仅是企业对员工一年努力工作的认可及对其所作贡献的奖励,而且成为企业激励员工,留住优秀人才的砝码之一。但有时却事与愿违,关于年终奖的劳动争议,特别是离职员工的年终奖问题在实践中往往成为引发劳动争议的导火索;另外,怎样制定年终奖的发放范围和标准、年终奖如何缴税等都成为企业与员工共同关心的话题。本期邀请到劳动法专家、长期致力于劳动法律实务与研究的王桦宇先生给大家就如何理解有关年终奖的法律概念以及如何应对和处理年终奖法律纠纷提供专业意见和应对策略。
