随着文化艺术产业、体育产业的蓬勃发展,文化、体育体制改革的逐步落实,越来越多经营性的文化、体育事业单位转制为企业,诸多经纪公司、影视制作公司、体育俱乐部纷纷改制成立,公司的各项经营与管理完全按照相关法律规定与市场接轨,这也为文化体育事业的发展带来了巨大的机遇与挑战,而其中最大的挑战就是人才的管理与规范。作为用人单位的公司应当按照《劳动合同法》明确责任、权利与义务,作为转制后的文化、体育人才更应当依据相关法律明确与用人单位的法律关系。改制后的双方将不再是旧体制下的人事关系,更不能用行业潜规则按“惯例”执行。
