一起普通的房屋建设合同纠纷,由于房屋质量问题引发了一场司法鉴定管理权之争。由法院和鉴定机构共同出具的鉴定书,司法行政机关认为违反法定程序,责令鉴定机构撤销鉴定,而法院却认为鉴定书“合法有效,证明力较大”。司法鉴定的“多头管理”让当事人和鉴定机构都感到无所适从。
