商誉的知识产权保护主要是从知识产权保护的客体来看的,商誉作为一种无形资产,是企业的一种综合优势,是企业持续发展的软实力,但对于企业商誉却缺乏强有力的保护,中国目前的商誉体制仍旧不完善。因此,本文以商誉的知识产权保护为内容,通过分析商誉的特征及组成,探究其知识产权保护的基础,并借鉴国外经验,从知识产权方面进行制度设计,以加强对商誉的专门保护。
The protection of goodwill of intellectual property is mainly from the object of intellectual property protection. As an intangible asset, goodwill is an integrated advantage of an enterprise and a soft power for the sustainable development of the enterprise, but it lacks of goodwill for the enterprise Strong protection, China’s current system of goodwill is still not perfect. Therefore, based on the intellectual property protection of goodwill, this article explores the foundation of intellectual property protection by analyzing the characteristics and composition of goodwill, and draws lessons from foreign experience to design the system from the aspect of intellectual property to strengthen the specialization of goodwill protection.
