我国农村宅基地的管理利用问题随着城市化进程的推进而不断激化。本文在厘清了农村宅基地的内涵的基础上,从土地景观、法律法规、产权状况三个不断推进的层次来分析农村宅基地管理利用上存在的问题,并认为产权不完整,限制了流转权,而导致农村宅基地地租无法实现是造成目前农村宅基地管理利用问题重重的关键要害。完善农村宅基地产权,推进农村宅基地的合理有偿流转有利于农村筹集发展资金,有利于土地生产要素流动,促进城乡和谐发展。
The management and utilization of rural house sites in our country are constantly intensified with the progress of urbanization. On the basis of clarifying the connotation of rural house sites, this paper analyzes the problems existing in the management and utilization of rural house sites from the three levels of land landscape, laws and regulations, and property rights, and considers that the property rights are not complete and the right to transfer , Which leads to the unfulfilled rented land rent in rural areas is the crux of the current problems in the management and use of homestead in rural areas.
