旭普林公司案是我国法院近年来对国际仲裁实施司法监督的典型案例。国际商事仲裁是商事性的法律服务,而不是公共服务,因此外国仲裁机构在中国内地进行仲裁属于国际服务贸易活动。在国际法层面,应当受到《服务贸易总协定》等的调整,而我国并未承诺开放外国仲裁机构在中国内地从事商事仲裁服务贸易;在国内法层面,根据我国《仲裁法》和《民事诉讼法》的规定,外国仲裁机构也不得在我国内地进行国际商事仲裁。
