运用行政法上的行政奖励理论来考虑《行政奖励法》的立法思路是一个误区。行政奖励不是一种独立的行政行为。要区分作为国家荣誉制度组成部分之一的政府奖励和作为具体行政行为之一的行政奖励。在此基础上,《行政奖励法》的立法思路主要包括:其一,《行政奖励法》应改为《政府奖励法》;其二,《行政奖励法》的制定要与《国家勋章法》相协调;其三,《行政奖励法》的调整内容包括政府荣誉称号、政府奖章以及与政府荣誉称号、政府奖章、国家勋章相关的物质奖励。只有循此思路,才能有助于《行政奖励法》立法工作的顺利展开。
It is a misunderstanding to consider the legislative idea of “Administrative Reward Law” by applying the theory of administrative reward in administrative law. Administrative rewards are not an independent administrative act. To distinguish between government incentives that are part of a national honor system and administrative rewards as one of the specific administrative actions. On this basis, the legislative thinking of “Administrative Reward Law” mainly includes: First, “Administrative Reward Law” should be changed to “Government Reward Law”; Second, the “Administrative Reward Law” should be formulated in accordance with the “National Medal of Merit” Thirdly, the adjustment of the Administrative Reward Law includes the honor of the government, the medal of the government, and the material rewards related to the honor of the government, the government medal, and the medal of the state. Only by following this line of thinking can we help the smooth development of the “Administrative Reward Law” legislative work.
