先秦以商鞅、韩非为代表的法家之学,以“刑名法术”为核。其所谓“法”者,若指向法律,则坐实于刑。重刑主义是法家思想的必然归宿,其理论基础包括任力不任德的实力主义、性恶论、重刑爱民论、民众愚昧论等;其内容包括刑主赏辅、“刑用于将过”、“以刑去刑”、“重刑连其罪”等。作为君主专制政治暴力统治的思想基础,重刑主义学说荒谬、残忍,必然导致对生命的蔑视、民生的摧残、基本人权的践踏,秦朝的暴政充分印证了这一点。汉朝以后儒、法合流,重刑主义遂成为中华法系的基本精神之一,影响深远,至今仍有必要认真检视与深刻反思
