李某,女,43周岁,某丝绸厂职工,1996年1月与丝绸厂签订了无固定期限的劳动合同。由于丝绸行业不景气,李某自1997年1月起,就开始在外搞经营,去厂里只是例行签到。1998年下半年,丝绸厂效益好转,遂要求职工严肃劳动纪律,按时上下班。但李某因其经营的业务效益很好,故未能按时上班, 轮到自己当班即请人代岗。1999年5月,厂领导对其多次指责未果后,以旷工为由将其除名。
