法律规避是指涉外民事法律关系的当事人为利用某一冲突规范,故意制造某种连结点,以避开本应适用的法律,从而使对自己有利的法律得以适用的一种逃法或脱法行为。本文拟从法律规避的构成要件及法律规避的性质两方面进行初步探讨。 Legal evasion refers to an act of escape or deception applicable to a law applicable to one’s own interests by the parties involved in the civil legal relations involving foreign interests who make use of certain conflicts and norms and deliberately create a certain kind of connecting point so as to avoid the law that should be applicable . This article intends to explore the constitutional avoidance of the elements and the nature of legal avoidance.
