《欧盟运作条约》第18条确立了禁止国籍歧视原则,该原则对国际航空运输领域的规制主要集中在各国对其他成员国的航空运输公司设立的市场准入限制方面,适用范围较窄。在欧洲法院近期做出的一份预先裁决中,指出欧盟成员国与第三国之间的航线运营,属于未自由化的领域,在欧盟没有专门的次级立法的情况下,应适用成员国的国内法,但该国内法不得与禁止国籍歧视原则相悖。这个判决对禁止国籍歧视原则做了扩大解释,体现了欧盟权能的扩张,对促进欧盟航空运输法的一体化具有积极作用。
Article 18 of the Treaty on the Treaty of EU establishes the principle of prohibition of discrimination on the basis of nationality. The principle is that the regulation of the international air transport field is mainly focused on the restriction of market access imposed by air transport companies of other countries on a narrow scope of application. In a recent preliminary ruling by the European Court of Justice, it was pointed out that the operation of airlines between EU member states and third countries is an area of non-liberalization. In the absence of specific sub-legislation of the EU, the application of the Domestic law, the domestic law must not contravene the principle of prohibition of nationality discrimination. The verdict extended the interpretation of the principle of prohibition of nationality discrimination and reflected the expansion of the EU’s capabilities and played a positive role in promoting the integration of the EU’s air transport law.
