目前学界和法律实务界对交通肇事逃逸的认定标准仍然存在着争议.根据我国和最高人民法院相关的司法解释,交通肇事中的逃逸是指逃避法律追究.这种认定并没有消除实践中人们对逃逸行为的争论,本文结合法理和典型案件的分析,试图对这一争论存在的原因做出了解释,并提出了完善交通肇事行为法律规范的建议.
