美国著作权法倡导的首次销售理论是对著作权的一种限制,其效力限定于在美国制造的产品及在国外制造并在美国授权销售的产品。对于他人未经授权进口在国外制造的产品,著作权人有权禁止。当首次销售理论不能成为进口商的辩护理由时,它就有了自己的效力边界。我国是否遵循美国首次销售理论的效力边界制定著作权平行进口的法律规则,应当从灰色市场、消费者、制造业和就业以及作为进口管制工具的著作权的角度分析立法的潜在影响。
The first sales theory advocated by the U.S. copyright law is a limitation on copyright, limited in its validity to products manufactured in the United States and products manufactured abroad and sold in the United States. For others to import products manufactured abroad without authorization, the copyright owner has the right to prohibit it. When the first sales theory can not be a justification for importers, it has its own boundaries of effectiveness. Whether China follows the legal boundary of the first sales theory in the United States and formulates the legal rules on the parallel importation of copyright should analyze the potential impact of legislation from the perspective of gray market, consumer, manufacturing and employment as well as the copyright as the import control tool.
