以雇佣为纽带的劳资关系中难以避免的会出现各种矛盾和冲突,剧烈的冲突爆发时就会引起罢工行为。世界各国以及国际组织都在致力于解决这种矛盾冲突以保证经济社会的稳定发展。随着我国经济结构的调整,罢工问题也日益增多。如何借鉴国外先进经验同时结合我国实际国情,正确认识罢工现象、解析罢工权,是本文研究的重点。
All kinds of contradictions and conflicts that are unavoidable in the labor-capital relations with employment as a link can cause strikes when a violent conflict erupts. All countries in the world and international organizations are committed to resolving this kind of contradictions and conflicts so as to ensure the steady development of economy and society. With the adjustment of China’s economic structure, the issue of strikes is also on the increase. How to draw lessons from advanced foreign experience and combine with China’s actual national conditions to correctly understand the strike phenomenon and resolve the right to strike is the focus of this paper.
