传统法律对生物识别信息的保护主要是以人格权、隐私权为基础的个人信息保护。这一保护模式随着个人信息商业价值的开发愈显不足。关于个人信息财产权保护的理论具有合理性且特别适合于生物识别信息的保护。在当代法学中,财产概念的使用更加灵活,不一定必须与具体物体相关。我国现有的法律和司法解释关于生物基因信息、身份信息、个人信息财产权的规定,都可能对生物识别信息财产权保护提供可借鉴的法律基础。将与人格特征相关以及与身体相关的生物识别信息作为特殊的财产予以保护是可能的。在具体操作方面,需要建立经济利益分配机制,引入类似版权的分类收费标准,由工商行政机构、行业监管机构制定具体的收费标准。
The protection of biometric information by the traditional law is mainly the protection of personal information based on personality rights and privacy. This model of protection becomes less significant as the commercial value of personal information is developed. The theory about the protection of personal information property rights is reasonable and especially suitable for the protection of biometric information. In contemporary jurisprudence, the use of the concept of property is more flexible and does not necessarily have to be related to specific objects. The existing laws and judicial interpretations in our country on biogenic information, identity information and personal information property rights may provide a legal basis for the protection of property rights in biometric information. It is possible to protect biological property-related and body-related biometric information as special property. In terms of specific operations, it is necessary to establish a mechanism for the distribution of economic benefits and introduce similar classification fees for charging fees. Specific charging standards shall be worked out by the industrial and commercial administrative agencies and industry regulators.
