近日,艺术品市场中除了金秋十月的香港拍卖市场引人关注之外,前些时日众多媒体报道的《中国(上海)自由贸易试验区总体方案》也曾引起艺术市场圈内人士的一番热议。因为在这个初始提交的总体方案中,其中一项建议为“在上海自由贸易试验区内允许外商投资拍卖企业从事文物拍卖业务,提出3年内暂停在自由贸易试验区实施现行的外资、中外合资、文物保护法等4部法律的有关条款。”在随后的最终表决中,其他3部法律的相关条款在自由贸易试验区内的暂停条款得以通过,唯独有关文物保护法的调整条款没有予以通过,而这一决议结果也再次引发人们对外资拍卖行进驻内地市场后能否从事文物拍卖的讨论。
