一、制定本法的必要性 房地产业是经济发展的基础性、先导性产业,是国民经济的支柱产业之一。房地产业的发展,不仅可以为城市经济发展提供基本物质基础和前提,而且有利于改善城市居民生活条件,为国家开辟一条重要财源。房地产业的国民经济和社会发展中的重要地位和作用,客观上要求用法律加以规范、引导、推动和保障。 党的十一届三中全会以来,特别是我国进行城镇国有土地有偿使用制度改革和房地产综合开发建设体制改革以来,我国房地产业迅速崛起。1992年邓小平同志视察南方发表重要谈话和党的十四大以来,改革和建设的步伐加快,房地产业的发展随之进入一个新的发展阶段。
I. The Necessity of Making the Law The real estate industry is a basic and leading industry in economic development and one of the pillar industries in the national economy. The development of the real estate industry not only provides the basic material foundation and premise for the urban economic development, but also helps to improve the living conditions of urban residents and opens up an important source of finance for the country. The important position and role of the real estate industry in the national economy and social development objectively require the use of laws to regulate, guide, promote and safeguard. Since the Third Plenary Session of the Eleventh Central Committee of the Communist Party of China, especially in our country, the reform of the system of paid use of urban state-owned land and the reform of the comprehensive development and construction of real estate have been taking place. The real estate industry in our country has risen rapidly. Since Comrade Deng Xiaoping visited major talks in the south in 1992 and the party’s fourteenth Congress, the pace of reform and construction has accelerated. The development of the real estate industry has subsequently entered a new stage of development.
