日本曾向联合国大陆礁层界线委员会(CLCS)申请冲之鸟礁享200海里之外的延伸大陆礁层。在2012年4月第29会期实质性议题投票,CLCS审议结果,5票赞成、8票反对、3票弃权,联合国大陆礁层界线委员会没有通过日本享有冲之鸟礁200海里之外的延伸大陆礁层。换言之,若日本不享冲之鸟礁200海里以外的延伸大陆礁层,解释上,也不该享有主张冲之鸟礁200海里以内的专属经济区之专属渔业与大陆礁层之专属矿藏。依法而论,日本着实很难推翻2012年CLCS审议结果。台湾“行政院”5月23日表示,“冲之鸟,他是‘岛’还是‘礁’,这还有争议,我们会尊重联合国岛屿界
Japan has applied to the United Nations Continental Reef Boundary Commission (CLCS) for its extended continental reef 200 feet away.
