最近,教育部与财政部、人力资源和社会保障部等五部委联合发布了《职业学校学生实习管理规定》(下称“新规”),使得实习生的话题又重新热起来。确实,招聘和使用实习生,越来越成为企业发现和培养后备人才,建立企业人才储备库的重要途径之一。不过目前,这一特殊群体并没有一个明确的法律层面的定义和概念,导致很多企业的HR晕头转向,搞不清楚企业使用实习生应当履行哪些法律义务。
Recently, the Ministry of Education and Ministry of Finance, Ministry of Human Resources and Social Security and other five ministries jointly issued the Probation Management Regulations for Vocational School Students (hereinafter referred to as the “new rules”), making the topics of intern again heated up again. Indeed, the recruitment and use of interns are increasingly becoming one of the important ways for enterprises to discover and train reserve personnel and establish a pool of corporate talent. However, at present, this particular group does not have a clear legal definition and concept. As a result, the HR of many enterprises is confused and it is unclear what legal obligations enterprises should employ.
