互联网开放平台正逐渐成为Web2.0时代的主流趋势,其给互联网公司带来巨大利润的同时也造成了复杂的知识产权纠纷,在著作权领域表现尤为明显。互联网开放平台属于网络服务提供商,其也能适用避风港原则作为免责条件,服务商主观认识要件的判断标准,通知程序的僵化以及服务商的营利模式等问题对避风港原则形成挑战。在立法中,必须对避风港原则的实施留有弹性空间;在司法实践中,必须根据具体的案件情况进行判断是否符合免责条件。
The Internet open platform is becoming the mainstream trend in the Web2.0 era. It brings huge profits to the Internet companies as well as complicated intellectual property disputes, especially in the field of copyright. Internet open platform is a network service provider, which can also apply the principle of safe haven as a disclaimer, the judgment standard of subjective understanding of service providers, the inflexibility of notification procedures and the profit-making mode of service providers pose a challenge to the principle of safe haven. In the legislation, we must leave room for flexibility in the implementation of the safe haven principle. In judicial practice, we must judge whether the exemption conditions are met according to the specific circumstances of the case.
