我国反倾销立法新近的修改确立了公共利益审查原则,但是,没有明确规定公共利益审查的具体程序。在利益日益分化的时代,实体上的多元利益目标很难达成共识。因此,利益代表表达意见的充分性就是确保立法和法律适用的可合理接受性的重要基础。反倾销公共利益审查的程序完善也就具有特殊的意义。本文通过对我国有关的立法规定以及2001年到2005年公共利益审查实践的梳理,认为现有的法律规定和实践做法在公共利益审查的程序上存在诸多缺失,应当明确利害关系方范围及其程序性权利,突出审查程序的独立性和明确其适用范围,以正确理解和适用反倾销的公共利益审查。
The recent revision of China’s anti-dumping legislation has established the principle of public interest review, however, there is no specific procedure for clearly examining the public interest. In times of increasingly divergent interests, it is difficult to reach a consensus on the substantive objectives of multiple interests. Therefore, the adequacy of the views of the interests representatives is an important basis for ensuring the reasonable acceptability of the application of legislation and law. Anti-dumping public interest review process also has a special significance. Through the combing of the relevant legislative provisions in our country and the review of public interest from 2001 to 2005, this paper argues that there are many deficiencies in the procedures for public interest review of existing legal provisions and practices, and should clarify the scope of the interested parties and their procedures Sexual rights, highlighting the independence of the review process and clarifying its scope of application so as to correctly understand and apply the anti-dumping public interest review.
