教育行政纠纷的大量出现表明了当前对高校学生权利救济的缺失。只有改变高校管理者的主位观念和学生淡薄的维权意识,通过不断完善教育相关理论,才能改变现有教育法律制度滞后的现状。完善高校学生权利救济的途径是:扩大教育行政复议的受案范围、细化教育行政诉讼的程序性规定,并以此为基础,引入非诉讼纠纷解决机制,建立教育仲裁、教育调解等更人性化的和谐处理方式。
The large number of administrative disputes in education shows the current lack of relief for college students’ rights.
