中国法官比公开承认法官自由裁量权的英美法系国家的法官掌握更大的自由裁量权空间。在我国,法官的自由裁量权还没被得到普遍的理性认识。本文从法官自由裁量权的必要性和法官在行使自由裁量权时存在的问题及规范法官自由裁量权的途径几方面对法官自由裁量权问题进行了探讨。 Chinese judges hold more room for discretion than judges in common-law countries that publicly recognize the judge’s discretion. In our country, the judge’s discretion has not been universally rationalized. This article explores the issue of judges’ discretion in terms of the necessity of judges’ discretion and the problems existing in judges’ exercise of discretion and the ways of regulating their discretion.
