合议庭评议阶段是指从裁判者退庭评议到宣判期间对案件进行讨论和作出决定的阶段。合议庭的评议是审判运行机制中最核心部分,其合理运作将直接决定着审判制度功能的发挥。该文首先论述合议庭评议的涵义和特征;其次结合合议庭评议原则论述我国在现阶段的发展现状;最后提出立法建议,并指出其现实意义。 The collegiate bench review stage refers to the stage from the judgment of the referee to the discussion and decision-making of the case during the sentencing. The collegial panel’s review is the core part of the trial operation mechanism, and its reasonable operation will directly determine the function of the trial system. This article first discusses the meaning and characteristics of collegial review; secondly, it discusses the current development of our country in the light of the collegiate bench reviewing principle; and finally puts forward the legislative suggestions and points out its practical significance.
