作为社会主义市场体系重要组成部分之一的房地产市场,在国民经济发展中日益显示出其重要地位和作用,受到党和政府的高度重视。在中国共产党十四届三中全会通过的《中共中央关于建立社会主义市场经济体制若干问题的决定》中,专门就“规范和发展房地产市场”问题有一段重要论述。本文就规范房地产市场特别是房地产一级市场问题,谈点个人浅识。一、房地产市场不规范的表现所谓房地产市场,它包括房地产的一级市场、二级市场和三级市场。这种划分是随着土地有偿使用和房屋商品化的改革,人们在实践中逐步得到的共识。即把政府出让土地称为房地产(或土地)的一级市场,把房地产投资者对受让土地的开发经营称为房地产的二级市场,把房屋所有者对房屋的再交易以及抵押、租赁等经营,称为房地产的三级市场。房地产的一、二、三级市场构成了完整的房地产市场体系。这种划分,在《国务院关于发展房地产业若干问题的通知》(国发[1992]61号)中,也已经有了明确的肯定。但是,由于在长期计划经济体制下,土地无偿使用,房屋
