货物招标采购实务中,招标人经常要求非制造商投标人提供制造商出具的授权。由于对制造商授权的认识存在差异,产生了诸如招标人能否与制造商签订合同等疑问。笔者拟以某机电产品国际招标的案例为例进行分析,并尝试指出《机电产品国际招标标准招标文件(试行)》(2014年4月版)(简称“《机电产品招标文件》”)制造商授权函文本所可能产生的误会。
In the bidding and purchasing practice of goods, tenderers often require non-manufacturer bidders to provide the authorizations issued by the manufacturer. Due to differences in manufacturer’s authorization, there arise questions such as whether the bidder can sign a contract with the manufacturer. The author intends to take the case of an international tender of electromechanical products as an example for analysis, and tries to point out that the bidding documents for international bidding of electromechanical products (Trial Version) (April 2014 edition) (referred to as “Bidding Documents for Electromechanical Products”) Manufacturer’s letter of authorization may be misunderstood.
