《国有土地上房屋征收与补偿条例》的颁布施行,标志着我国城市房屋征收补偿立法制度进入了一个新阶段。但实行近一年来,全国强制拆迁事件频发不止,极大地影响群众对于我国立法的信任感以及地方执法工作的开展。立法后评估方法早在西方国家广泛应用,对立法完善和法治建设起到很大的作用。以《国有土地上房屋征收与补偿条例》为例,分析其实施效果及相关制度,建立我国城市房屋征收补偿立法后评估体系,也为我国立法后评估体系建立提供参考。
The promulgation and implementation of the “Regulations on the Collection and Compensation of Houses on State-owned Land” signify that the legislative system for the compensation for urban housing acquisition in our country has entered a new stage. However, nearly a year since the implementation of forced evictions throughout the country more frequently, greatly affecting the people’s trust in our country’s legislation and the implementation of local law enforcement. The method of post-legislative appraisal has been widely used in western countries as early as in the past and has played a significant role in improving legislation and building the rule of law. Take the “Regulations on the Collection and Compensation of Houses on State-owned Land” as an example, analyzes its implementation effect and related systems, and establishes post-legislative evaluation system for urban housing compensation in China. It also provides reference for the establishment of the post-legislative evaluation system in our country.
