高校与学生的关系存在着纵向的服从与被服从的关系(行政法律关系)与横向的平等主体间的自由合意的关系(即民事法律关系)的交集。然而高校在行使管理权时,滥用国家赋予的行政权力,从而造成了各种侵犯学生正当权利的事件的发生。本文从高校管理过程中与大学生权利产生冲突的几个方面进行阐述,针对隐私权、学习权、知情权、申诉权等方面的权利冲突,立足于现有法律的规定提出了冲突的解决办法,以保障大学生各个方面的正当权利的实现。
The relations between colleges and students have the intersection of the vertical obedience and obedience (the relationship between administrative law) and the free and desirable relationship (that is, the civil legal relations) between horizontal equal subjects. However, when exercising their management rights, colleges and universities abused the administrative powers granted by the state, resulting in all kinds of incidents that infringed the legitimate rights of students. This article elaborates several aspects of conflicts with college students’ rights in the process of university administration. According to the conflicts of rights in the aspects of privacy, study rights, right to information, right to appeal and so on, this article puts forward the solution to the conflict based on the existing laws, In order to protect the realization of the legitimate rights of all aspects of college students.
