本文探讨了物权法草案总则中的若干重要问题。作者认为,物权的概念中应当包括对世性,应当规定物权优先于债权的规则,违反物权法定原则的效果,区分所有权移转中的公示方法与他物权设定合同的公示方法,区分动产的善意取得和不动产的公信原则,增加实质审查的内容,进一步完善异议登记制度,对有权查阅不动产登记簿的人作出适当限制,对于法院的确权判决和裁定对物权变动的影响应当作出更明确的规定。
This article explores several important issues in the general rules of the draft law.
