(一) 目前,我国北京、上海、武汉陆续出现了企业产权转让活动。企业产权转让的实施和发展,促进了对已形成的资产存量实现优化重组和合理流动,有利于优化社会范围内的资源配置,从总体上提高企业资产的经营效率和经营效益,有效地处理国家投资增量有限和社会资产存量部分闲置的矛盾。它既能适应合理调整社会生产力的要求,又可避免由于企业破产,而产生的社会震动。因此,企业产权转让的实施和发展,是优化宏观资源配置机制,提高整个社会资产效益的必然要求。从一般意义上来说,产权是指资产所有权。但在当代经济中,资产所有权与资产的占有权、使用权和收益权可以在一定条件下以某种方式产生不同程度的分离,后者并可在一定时期实行有偿让渡。这种让渡,事实上是该项资产的生产权和收益权的转移。例如资产出租,并不涉及该项资产所有权的变
