近年来,随着查办职务犯罪的需要,一些地方的检察机关在查办职务犯罪中开始引入特殊侦查措施,但因为我国相关法律并没有赋予检察机关特殊侦查权,对此,引起了法学理论及实务界的争议。本文从特殊侦查措施在侦查职务犯罪中的特殊功能入手,谈谈职务犯罪侦查中引入特殊侦查措施的必要性和可行性,主张从法律上赋予检察机关特殊侦查权。
In recent years, with the need of investigating and handling job-related crimes, the procuratorial organs in some places have begun to introduce special investigation measures in the investigation of job-related crimes. However, because the relevant laws in our country do not give the procuratorial organs special investigative powers, this has given rise to the theory and practice of jurisprudence Dispute in the community. This article starts with the special function of special investigative measures in investigating duty crimes, and discusses the necessity and feasibility of introducing special investigative measures in the investigation of duty crime. It advocates giving the procuratorial organs a special investigative power by law.
