近现代宪政由英国首开先河,其原因是多方面的,特别为学界所认可的即为其具有悠久的法治传统。本文拟从回顾中世纪英国法治传统的早期形态“王在法下”观念的确立入手,简单介绍了该观念的起源、发展和形成过程。试图从一幅宏大的英国宪政发展史图景中展现出其中的一个小小部分。
The reason why modern constitutional government first opened up by the United Kingdom was due to many reasons. It was recognized especially by the academic community as having a long tradition of rule of law. This article intends to start with the establishment of the concept of “under the law” of the early form of the rule of law in medieval England and briefly introduces the origin, development and formation process of the concept. Trying to show a small part of the grand picture of the history of British constitutional development.
