法律法规对体罚的界定不清、笼统和含糊,以及绝对的否定体罚,导致教师对体罚二字的理解不一,使得教师在教学实践中难以把握好惩戒学生的分寸,影响教育效果。界定好体罚的边界和区分清楚体罚和惩戒,用程序控制适当体罚,严格追究过当体罚的法律责任,才能更好的对体罚进行法律规制。
The unclear, general and ambiguous legal punishment of corporal punishment and the absolute negation of corporal punishment result in different interpretations of the corporal punishment by teachers, which makes it difficult for teachers to grasp the sense of discipline of their pupils and affect the educational effect in their teaching practice. To define the boundaries of corporal punishment and make a clear distinction between corporal punishment and disciplinary punishment, and to properly control the use of corporal punishment by procedures, and strictly follow the legal responsibility of corporal punishment so as to better regulate corporal punishment.
