日前,最高人民法院、最高人民检察院、人力资源社会保障部、公安部下发了《关于加强涉嫌拒不支付劳动报酬犯罪案件查处衔接工作的通知》(以下简称《通知》)。《通知》要求,要进一步完善劳动保障监察行政执法与刑事司法衔接工作机制,切实有效发挥刑法打击拒不支付劳动报酬犯罪行为的作用。针对执法实践中遇到的突出问题作出了明确具体的规定。为了解决行为人逃匿后相关证据无法获得的问题,《通知》规定,由于行为人逃匿导致工资账册等证据材料无法调取或用人单位
