数月以来,一些专家学者就我国签署加入《公民权利和政治权利公约》所涉及的刑事沉默权问题进行了广泛而深入的探讨。对于目前中国是否应确立沉默权制度,赞同者有之,反对者亦有之,笔者持赞同的观点,就此谈一点自己粗浅的看法。就笔者所见的观点中,反对确立沉默权者最主要的理由是“目前中国‘刑事侦查资源’不足,实行沉默权制度将不利于提高办案 In the past few months, some experts and scholars have conducted extensive and in-depth discussions on the issue of the criminal right to silence that China has signed to accede to the ”Convention on Civil and Political Rights.“ As to whether China should establish a system of the right to silence at present, there are those who agree with it and those who oppose it. The author supports the view that we have the same opinion. In the opinion I have seen, the most important reason for opposing the establishment of the right to silence is that ”at present, China has not enough resources for criminal investigation and the implementation of the right of silence will not be conducive to improving the handling of cases
