物业管理合同是约定业主和物业管理企业在物业管理活动中双方权利义务的合同。物业管理合同的当事人是全体业主和物业管理企业,业主委员会不是合同的当事人。《物业管理条例》对物业管理合同违约救济中的主体规定不够明确,应加以完善;尤其应明确业主委员会的诉讼资格。
Property management contract is the agreement of the owners and property management companies in the property management activities rights and obligations of both parties. Property management contract is the owner of all the owners and property management companies, the owners committee is not the parties to the contract. The “Property Management Ordinance” on the property management contract breach of contract relief in the main provisions are not clear enough, should be improved; in particular, should be clear owners of the litigation qualifications.
