我国博物馆长期处于行政化管理,市场意识、市场风险都较薄弱。由于博物馆业务工作与一般行业具有较强的差异性,这就意味着在博物馆业务工作中形成的各种法律关系同样与一般法律关系有着较强的差异性。为了更好地把握这种区别,保证博物馆的合法权益和文物的安全,本文将仅涉及博物馆业务活动合同归集统称为博物馆合同。通过对博物馆合同的概念、特点、签订原则、主要类别、一般内容进行分析,说明博物馆合同的起草、审查和管理制度的重要性,目的是加强和提升博物馆的法制建设和管理。
Our museum has long been in administrative management, market awareness, market risk is weak. Because of the strong difference between the museum business and the general industry, this means that the various legal relationships formed in the museum business also have strong differences with the general legal relations. In order to better grasp the difference and ensure the legitimate rights and interests of museums and the safety of cultural relics, this article will refer only to the collection of contracts of museum business activities collectively referred to as museum contracts. By analyzing the concept, characteristics, signing principles, main categories and general contents of the museum contract, the author expounds the importance of the drafting, reviewing and managing system of the museum contract with the aim of strengthening and promoting the legal system construction and management of the museum.
