一驰名商标是在一定市场范围内享有较高声誉的、为相关公众所熟知的商标。与普通的商标相比,驰名商标往往代表着更高的质量或服务,包含了商标所有人更多的投入和商誉,也更经常地受到其他生产者和经营者的假冒仿靠。对于这种企业的宝贵无形财产,世界各主要国家均提供特殊的、优于普通商标的法律保护。我国2001年《商标法》明确了与现有国际规则相一致的驰名商标特殊保护制度,即在相同或类似的商品上不得注册或使用他人未在中国注册的驰名商标;在不相同或不相类似的商品上不得注册或使用他人已经在中国注册的驰名商标。事实上我国对驰名商标的保护是比较全面的,除了《商标法》明确禁止以“复制、摹仿或者翻译”等方式注册或使用驰名商
A well-known trademark is a trademark that enjoys a high reputation in a certain market and is well-known to the relevant public. Well-known marks tend to represent higher quality or service than ordinary marks, include more input and goodwill from the trademark owners, and are more often faked by other producers and operators. For the precious intangible property of such enterprises, all major countries in the world provide special legal protection over ordinary trademarks. China’s Trademark Law of 2001 specifies the special protection system of well-known marks in conformity with the existing international rules, that is, it can not register or use well-known marks which other people are not registered in China for the same or similar goods; Similar goods may not be registered or use other people’s well-known trademarks registered in China. In fact, the protection of well-known trademarks in our country is relatively comprehensive, except that the Trademark Law specifically prohibits the registration or use of such well-known trademarks as “copy, imitation or translation”
