沈阳读者王某问:今年8月底,中央电视台报道了对陈希同犯罪行为的审判,最高人民法院依据1979年刑法和1997年刑法,判处其有期徒刑16年。请问:为什么同一个人的犯罪行为,适用了不同的刑法?沈阳读者王某:你所提出的问题,涉及法理学上法的溯及力问题。法的溯及力主要是指法对它生效以前的事件或行为是否有溯及既往的效力。如果有溯及既往的效力,则法有溯及力,否则,法没有溯及力。例如,我国新刑法于1997年10月1日生效,那么,1997年10月1日以前的事件或行为,是否适用新刑法,如果可以适用,则我国刑法有溯及力,如果不可以适用,则我国刑法没有溯及力。
