最近,在处理20年建设用地使用权期限截止的问题上,温州市相关部门同意自动续期,但需要对建设用地使用权和房屋所有权的财产价值进行估价计算,让相关的公众补缴建设用地使用权的费用。由于该政策涉及到相关公众的财产利益,因此在全国范围内引起各界的争论。通过对多位专家学者意见的解读,以及对住宅建设用地使用权的功能性分析,笔者认为住宅建设用地使用权到期以后无条件自动无偿续期符合立法的目的性解释结论,对于保障居民安居乐业、生存发展具有积极的促进作用。
