国际法上的个人究竟处于何种地位,理论界一直众说纷纭。但近代以来越来越多的人都逐渐接受个人可以成为国际法的主体的观点。本文主要从对人权的保护方面,分两个部分对个人的国际法地位做一下简单的论述:第一部分,从对传统主权观的批判来说明人权与主权的关系;第二部分,从国际或区际公约入手来说明为了保护个人的权利,应当使个人在有限的范围内享有主体的资格。
The status of individuals in international law is in fact what the theorists have been divided on. However, in the modern era, more and more people are gradually accepting the view that an individual can become the subject of international law. This article mainly discusses the status of the individual’s international law in two parts in terms of the protection of human rights: The first part illustrates the relationship between human rights and sovereignty from the critique of the traditional sovereignty; the second part, from the international or regional International conventions begin to illustrate that in order to protect the rights of individuals, individuals should be entitled to a limited extent.
