以调整资产阶级民主法治制度的应用范围从而为之作历史辩护为宗旨,哈贝马斯构造了当代资本主义条件下的合法性批判理论,似乎从民主形式角度为资产阶级民主法治的合理性做出了理论论证。但是,这一论证的理论基础在实质上包含逻辑联系幻觉,属于范例性思维而非论证前提发现条件下的逻辑新思维,不具有它的书写形式所当主张的可靠性。同时,其“重构”结论按照其论证方式的事后诠释本性,在逻辑上就不具有排他性,因而不能限制民主法治道路选择的想象力。两相叠加,使哈贝马斯的合法性批判既不能主张理论道路的必然性,也不能必然地证明资产阶级民主法治的选择唯一性。这种对哈贝马斯合法性批判的批判,赋予多元地探索社会民主实现模式以逻辑可能性和实践智慧上的正当性。
Habermas constructs the theory of critique of legitimacy under the conditions of contemporary capitalism with the aim of adjusting the scope of the application of bourgeois democracy and the rule of law so as to make a historic defense for it. It seems that from the point of view of the form of democracy, Habermas does the rational work for the bourgeois democracy and the rule of law A theoretical argument. However, the theoretical basis of this argument, which essentially contains the illusion of logic, belongs to the logical new thinking under the conditions of the discovery of the exemplary thinking rather than the proof of the premise, and does not have the reliability of the claim that its written form should be. In the meantime, the factual interpretation of its “reconstruction” conclusion according to its method of argumentation is not logically exclusive and therefore can not limit the imagination of the choice of the path of democratic rule of law. The superposition of the two phases makes the criticism of Habermas’s legitimacy can neither advocate the inevitability of the theoretical path, nor can it necessarily prove the uniqueness of the choice and bourgeois democracy and the rule of law. This criticism of Habermas’s critique of legitimacy has given the party multiple reasons to explore the logical possibility and practical wisdom of the mode of social democracy.
