司法文书是司法机关在司法实践中按照法律规定的职能与程序撰写的具有法律效能的专业文书。这种法律文书的制作既要符合国际通行的款式和中国的司法实际,又要叙述得当、逻辑严密、语言文字规范。反之,如果法律文书违背规则,释法不当,语言文字欠规范,必将损害司法的神圣,影响执法者的形象和当事人的利益。本刊在《咬文嚼字》杂志主编郝铭鉴先生的大力支持下,在上海政法学院宋山龙先生的鼎力相助下,开设了“法言咀嚼”栏目。其初衷就是通过对法律文书、涉法报道等法律文字作品的咀嚼,即从字词、语法、逻辑和修辞等层面反刍斟酌,以规范法律语言,普及法律常识和探究法理内涵,推进法治文明。本刊开办此栏目是法律文化宣传工作的一种尝试。在此实践中,恳望得到司法战线同仁和广大读者的理解、支持和帮助。
Judicial instruments are legally effective professional instruments written by judicial organs in judicial practice in accordance with the functions and procedures prescribed by law. The production of such a legal document must conform to both the internationally accepted style and the judicial practice in China, but should also be well-described, well-knit, and standardized in written language. On the contrary, if the legal instruments violate the rules, the improper interpretation of laws, the lack of standardization of language and writing will surely undermine the sacredness of the judiciary and affect the image of law-enforcers and the interests of the parties concerned. With the strong support of Mr. Hao Mingjian, editor in chief of “Biting the Word” magazine, the magazine opened with the help of Mr. Song Shanlong from Shanghai Politics and Law Institute. Its original intention is to promote the civilization of rule of law through legalizing the writing of legal instruments and legal reports, that is, from the aspects of words, grammar, logic and rhetoric to regulate the legal language, popularize legal common sense and explore the connotation of jurisprudence. This article run this column is an attempt to promote legal culture. In this practice, we earnestly understand, support and help our colleagues in the judicial front and the vast readership.
