《反假冒贸易协定》(ACTA)的制定表明知识产权国际保护与多边贸易体制的联合出现了松动,知识产权国际保护产生了由多边体制向复边体制发展的新动向。以ACTA的出现为线索对知识产权国际保护体制历史变迁的梳理及对其所暗含的利益冲突与力量博弈的分析,可以在一个更为广阔的学术脉络上理解后TRIPS时代知识产权国际保护复边体制发展的新趋势,并由此揭示发展中国家在知识产权国际保护问题上可能面临的问题及应有的立场与对策。
The development of the ACTA has shown the loosening of the coalition between international protection of intellectual property and the multilateral trading system and the new international protection of intellectual property resulting in the development from a multilateral system to a multilateral one. Taking the appearance of ACTA as a clue to the historical change of the international protection system of intellectual property and the analysis of the game of conflict of interest and power implied by it, we can understand the international protection of intellectual property in the TRIPS era after a much broader academic context The new trends in the development of the system, and thus reveal the problems that developing countries may face in the issue of international protection of intellectual property and their due positions and countermeasures.
