本文认为“刑事直诉”应当是以未逮捕案件为对象的一种完整的刑事诉讼程序,包括侦查、审查起诉、审判、执行各个阶段,其直接依据是刑事诉讼法的相关规定。在理论研究方面,明确地将刑事直诉作为研究对象的学术论文或专著非常少。直诉程序中犯罪嫌疑人的权利是否得到了应有的保障,直诉程序是否通畅,是否符合程序原则,是否具备有效的监督机制,这些问题都尚未被理论研究所关注。相比之下,实务部门以刑事直诉程序为对象的文字资料比较多。这些资料多是公安机关、检察机关工作人员所作的工作总结、工作经验介绍,故往往只反映局部地区在办理直诉案件时的一些特殊工作经验,或者只反映直诉程序的某一方面,而无法将直诉程序的司法实践过程较全面地予以呈现。
This paper argues that “criminal prosecution” should be a complete criminal procedure based on the cases of non-arrest, including the stages of investigation and prosecution, trial and execution, and its direct basis is the relevant provisions of the Criminal Procedure Law. In theoretical research, there are very few academic papers or monographs that explicitly criminal prosecution. Whether the criminal suspect’s right in the direct prosecution procedure should be properly protected, whether the direct prosecution procedure is unobstructed, whether it meets the procedural principle and whether there is an effective supervision mechanism have not been paid attention to by theoretical research. In contrast, substantive departments to prosecute criminal proceedings for the object of more text data. Most of these materials are summaries of work done by public security organs and procuratorial work personnel and introduction of work experience. Therefore, they often only reflect some special work experience of local areas when handling direct cases, or only reflect some aspects of the direct proceedings. It is impossible to present the judicial procedure of the direct proceedings more comprehensively.
