不动产善意取得是指受让人出于对于登记证书的信赖而与实际上的无权处分不动产的让与人交易,假如受让人在取得该不动产时乃是出于善意,则其可以取得该不动产的所有权,原不动产的实际所有人不能要求其返还原物。善意取的制度构建目的乃是在所有权和交易安全之间寻得恰当之平衡点,保障善意第三人的合法权益。本文将简单介绍不动产物权的善意取得。
