“小产权房”目前已成为社会的热点问题,其折射的社会矛盾和利益冲突是制度性的和深层次的。我国正在建立和完善社会主义市场经济,房地产市场是其中的一个重要组成部分。目前国家正在逐步建立与国有土地出让、转让制度相衔接的农村集体建设用地出让、转让制度。“小产权房”作为一种新生事物,有它合理存在的原因,而且我国对于“小产权房”的法律制度还很不完善,不能说“小产权房”都是违法的。本文简要介绍了“小产权房”的成因,合法的理由和意义,并对“小产权房”的法律规制提出了建议。

At present, the state is gradually establishing a transfer and transfer system of rural collective construction land that is linked with the transfer and transfer system of state-owned land. “Small property room ” as a new thing, there is reason for its existence, and our legal system for “small property room ” is still not perfect, can not say “small property room ” are illegal of. This article briefly introduces the causes, legal reasons and significance of “small property room” and puts forward suggestions on the legal regulation of “small property room”.
