在现实主义主导的国际体系中 ,国家行为体是否选择通过国际司法解决国际争端 ,在何种情况下做出或拒绝这种选择 ,从深层次决定因素考察 ,取决于争端背后的国家利益 ,而选择的过程就是一个决策的过程。作为一项在有着各种不确定因素和变量的条件下从多种备选方案中选择和决定的行为 ,决策应当是一种理性的活动。在选择国际司法的决策过程中 ,国家理性表现为行为体对于自己的短期目标(利益 )和长期目标 (利益 )关系的态度。国际环境、国家间关系、国家对国际司法的信任程度、争端性质和国际司法自身的特性、决策者的背景以及决策心理都是影响国家决策的因素
