香港回归祖国后,原有法律体系在私法层面上没有重大改变,但以《基本法》为核心的公法,却因《基本法》的实施产生了不少新的法律问题,从而成为回归后香港法制中发展最为迅速的领域。从1997年香港终审法院的成立之日起,与《基本法》相关的判例法体系的发展,特别是涉及“一国两制”的司法判例的发展,成为了终审法院须面对的最大挑战。本文回顾终审法院在1997—2009年在前首席大法官李国能先生领导下,如何建立与《基本法》相关的判例法体系。本文将以叙事的方式介绍终审法院在这个领域内形成的判例法,让读者了解在不同的时期和阶段,香港终审法院在解释和实施《基本法》时所面对的挑战以及它如何应对这些挑战。在本文的结论部分,作者亦会对前首席法官李国能领导下的终审法院在发展《基本法》判例方面的表现予以评析。
Since the return of Hong Kong to the motherland, the original legal system has not undergone any major change at the level of private law. However, the public law centered on the “Basic Law” has created many new legal problems due to the implementation of the “ The fastest growing area. Since the founding of Hong Kong Court of Final Appeal in 1997, the development of the case law system in relation to the Basic Law, especially the judicial precedent involving ”one country, two systems “ has become the greatest challenge that the Court of Final Appeal must face. This article reviews how the Court of Final Appeal, under the leadership of the former Chief Justice, Mr LI Kwok-nang, from 1997 to 2009, established a case-law system that is relevant to the Basic Law. This article will introduce the CFA’s case law formed in this area by way of narration, so as to let readers know the challenges Hong Kong CFA has faced in interpreting and implementing the ”Basic Law“ at different times and stages and how it can handle these challenges . In the conclusion part of the article, the author will also comment on the performance of the Court of Final Appeal under the leadership of the former Chief Justice, Li Guoneng, in developing the precedent of the ”Basic Law."
